This privacy information tells you how wilkon e.K. processes your applicant data, in accordance with the duty to inform under Art. 13 GDPR.

Summary:

  • We use your data solely for the purpose of your application.
  • Access is clearly defined throughout the process: only the staff handling the application and those deciding on the appointment see your documents.
  • Your inclusion in our talent pool for future vacancies only happens with your consent.
  • If you are not appointed and no consent has been given, we delete your data after four months.
  • If you are appointed, we transfer the relevant data to your personnel file.

How we protect applicant data
Under Art. 4 (1) GDPR, your personal data comprises all information relating to you or which can be related to you, in particular by reference to an identifier such as a name or an applicant number by which you can be identified within the company.

Applicant data is stored and processed in human resources systems. The technical setup is designed so that only a narrowly defined group of specifically authorised persons has access, and any other access or disclosure of the data is prevented according to the state of the art.

Personal information and personal data
Through your application we receive information, both on paper and in digital form. This is the data you provide to us in the course of your application, for example:

  • Name
  • Address
  • Date of birth
  • Place of birth
  • Details of your schooling, vocational training, further training and qualifications
  • References and certificates
  • Curriculum vitae
  • Any further details and documents you provide to us

Legal basis for processing your personal data
Your data is required in order to carry out pre-contractual measures (Art. 6 (1) (b) GDPR). This means that we need and therefore process your data for the purpose of a possible appointment.

Your personal data may likewise be processed on the basis of applicable law (Art. 6 (1) (c) GDPR).

In individual cases we may ask for your consent to process or transfer your data — for instance where your application is to be retained for longer. Such consent is voluntary and can be withdrawn by you at any time with effect for the future.

Purposes of collection and processing
We collect, process and use your personal data solely for the purposes of your application (that is, to establish an employment relationship).

Processing for purposes other than those stated only takes place where it is permitted under Art. 6 (4) GDPR and compatible with the original purposes. We will inform you before any such further processing of your data.

Transfer of your personal information
Your data is stored in an applicant management system and processed on the provider’s servers. We have concluded a contract on processing on our behalf in accordance with Art. 28 GDPR with that provider, which safeguards your data and prohibits any unauthorised disclosure to third parties.

Retention period
Your personal data is only stored for as long as knowledge of the data is necessary for the purposes of the employment relationship or the purposes for which it was collected, for as long as statutory or contractual retention requirements exist, or for as long as your consent to longer storage applies.

Where no contractual relationship comes about, we retain your application data for four months for the purposes of demonstrating compliance with the General Equal Treatment Act (AGG), unless you have consented to inclusion in the talent pool.

If you give us your consent, we will include your data in our applicant database for twelve months. After that, your data is deleted automatically.

Where a contractual relationship does come about (that is, an appointment), we transfer the necessary information to your personnel file.

Your data protection rights
You have the right to information about the personal data stored about you, about the purposes of the processing and about the retention period.

To exercise your right of access you may also receive extracts or copies. Should data be incorrect or no longer necessary for the purposes for which it was collected, you may request its rectification, erasure or the restriction of processing. Where the processing procedures provide for it, you can also view and, if necessary, correct your data yourself.

Should grounds arising from your particular personal situation speak against the processing of your personal data, you may object to processing insofar as it is based on a legitimate interest. In such a case we will only process your data if there are compelling grounds for doing so.

Withdrawal of consent
Where processing is based on consent, you may withdraw the use of your data at any time with effect for the future. An e-mail to datenschutz@wilkon.de is sufficient.
